These Terms of Use (“Terms”) govern your access to and use of all training programs, certification services, digital platforms, websites, and related materials provided by Newe's Training Center (“NTC,” “we,” “our,” or “us”). By accessing our website, enrolling in any OSHA‑authorized or NCCER‑accredited training, or using any service we make available, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must discontinue use of our services immediately.

These Terms establish the rights and responsibilities of all users, including trainees, employers, contractors, and visitors, and outline the conditions under which training content, assessments, credentials, and digital resources may be accessed or used. They also define limitations of liability, intellectual property protections, acceptable use requirements, and procedures for resolving disputes. Your continued use of our services constitutes ongoing acceptance of these Terms and any updates we may implement to maintain regulatory compliance or improve operational standards.

1. Agreement to Terms

  • These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”) and Newe's Training Center (“NTC,” “we,” “our,” or “us”). By accessing our website, enrolling in training, or using any service we provide, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Eligibility

  • Users must be at least 18 years old or legally authorized by an employer or guardian to participate in OSHA or NCCER training programs. By using our services, you represent that you meet all eligibility requirements.

3. Training Services Provided

  • We offer OSHA‑related safety training, NCCER‑accredited craft training, assessments, certification processing, and related educational services. Access to specific programs may require employer authorization, identity verification, or compliance with regulatory prerequisites.

4. User Responsibilities

Users agree to:

  • Provide accurate and complete information during enrollment.

  • Follow all safety rules, facility policies, and instructor directions.

  • Maintain professional conduct during training.

  • Use training materials only as permitted under these Terms.

5. Prohibited Conduct

Users may not:

Share login credentials or access codes.

  • Copy, distribute, or reproduce training materials, exams, or proprietary content.

  • Attempt to falsify training records, certificates, or NCCER documentation.

  • Engage in disruptive, unsafe, or unlawful behavior during training or site use.

6. Intellectual Property Rights

  • All training materials, videos, manuals, assessments, logos, and digital content are the exclusive property of the Company or its licensors (including NCCER). Users receive a limited, non‑transferable license for personal training use only. Unauthorized reproduction or distribution is strictly prohibited.

7. NCCER Registry & OSHA Compliance

  • For NCCER programs, User information and training results may be submitted to the NCCER Registry for credential verification. OSHA‑related training records may be retained or shared with employers or regulatory bodies as required by law. Users consent to these compliance‑related submissions.

8. Payment Terms

  • All fees must be paid in accordance with posted pricing or employer agreements. Failure to pay may result in suspension of training access, withholding of credentials, or cancellation of enrollment. Third‑party payment processors may be used for secure transactions.

9. Refunds & Cancellations

  • Refunds, cancellations, and rescheduling are governed by our posted Refund Policy. Certain programs, assessments, or credentialing fees may be non‑refundable due to regulatory or administrative requirements.

10. Facility Safety & Liability

  • Users must follow all safety protocols. Participation in hands‑on training involves inherent risks. By enrolling, Users acknowledge these risks and agree to comply with instructor guidance. The Company is not liable for injuries resulting from failure to follow safety instructions.

11. Website Use & Content

  • Users may not misuse the website, attempt unauthorized access, interfere with system operations, or upload harmful content. All website content is provided “as‑is” without warranty.

12. Privacy & Data Protection

  • Use of our services is also governed by our Privacy Policy, which explains how personal information is collected, used, and protected. By using our services, Users consent to all data practices described therein.

13. Termination of Access

  • We reserve the right to suspend or terminate User access for violations of these Terms, unsafe conduct, non‑payment, fraud, or misuse of training materials. Termination may include revocation of access to online portals or withholding of certificates.

14. Disclaimers

  • Training outcomes, certifications, or credentials do not guarantee employment or advancement. OSHA and NCCER certifications are subject to regulatory standards and may require renewal or additional verification.

15. Limitation of Liability

  • To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages arising from training participation, website use, or reliance on provided materials.

16. Governing Law

  • These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law principles. Any disputes shall be resolved in the appropriate courts located in Harris County, Texas.

17. Changes to Terms

  • We may update these Terms at any time. Updated versions will be posted with a revised effective date. Continued use of our services constitutes acceptance of the updated Terms.
